TERMS AND CONDITIONS FOR PHOTOGRAPHY

Prices and payment

At Studio Merkbar, all prices are stated including VAT unless otherwise indicated. After the photo shoot, you will normally receive a link to a gallery from which you can select your images, download and pay. Downloads/payments cannot be cancelled/refunded. You will then receive an invoice by email. In the case of a more extensive shoot, you will first receive a gallery where you can select images for editing. Once selected, the number of images cannot be changed, as I then begin editing, and you will receive the finished images together with an invoice for payment. This process is agreed upon before the photo shoot.

Storage of images

After receiving your finished images, I keep all images from the shoot for 6 months. After 6 months, I keep the selected images for a further 1 year.

Travel

Travel exceeding 10 km to and from the company's address is charged at DKK 3.81 per km, which is added to the total price.

Changes and cancellation

If changes arise to our agreement, please inform me as soon as possible, out of consideration for my calendar, since I turn down other assignments as soon as your booking is confirmed. If the time is changed or the shoot is cancelled later than 48 hours before the agreed photo shoot, a fee of DKK 800 including VAT will be charged, as I then have very little chance of filling the slot again. This can be waived by agreement if, for example, the shoot is weather-dependent.

I reserve the right to cancel a shoot due to illness or other unforeseen events. In that case, I will try to arrange a new date as soon as possible.

Delivery

All images are delivered digitally in high and low resolution unless otherwise agreed.

After the photo shoot, the agreed number of fully edited images will be delivered within 2 weeks unless otherwise agreed in advance.

Copyright

As the photographer, I retain the copyright to the images, and the customer has a right of use.

As the photographer, I hold the copyright once the images have been delivered. If I wish to use the images for public purposes, e.g. on social media, I always obtain the customer's consent first and respect it if the customer does not want the images published. If the customer wishes to use the images for the press or other public media, Studio Merkbar c/o Birgitte Heiberg Andersen must be credited (pursuant to the Danish Copyright Act § 3, I as the photographer have the right to be credited by name upon publication of the images).

Buy-out of images

If you wish to buy out the images (so that the photographer no longer holds the copyright), this costs an additional 50% on top of the total price. If the customer buys out the images, the customer has unlimited right of use of the images for digital use, on social media and in print. The images may be shared but may not be resold. Upon buy-out of the images, the customer does not need to credit the photographer, but is of course welcome to do so. Buy-out of images always takes place by prior agreement between you as the customer and me as the photographer.

Use of images from the website

Under the Danish Copyright Act, it is not permitted to use or copy images from this website or associated social media and use them for your own social media, websites or private purposes without a prior written agreement with PHOTOGRAPHER Birgitte Heiberg, Studio Merkbar.

Should this happen anyway, a fee of DKK 950 per image will be invoiced without further notice, and removal/deletion of the image may be demanded. The same applies to the use of images bearing a watermark. Further details on copyright can be found in the Danish Copyright Act.

Right of use

As a customer, you naturally receive the right to use the delivered images. To protect me as the photographer, the following conditions for the right of use apply.

General conditions for use

Before delivery, careful thought has been given to format, image composition and editing in order to achieve the right expression. The use of filters and other alterations to the images (e.g. cut-outs) that change my expression as a photographer is therefore not permitted. If you want a different expression, please contact me to discuss the possibilities.

Conditions for commercial use

Upon delivery of the images, permission is also granted to use the images for marketing the business activity stated at the time of booking. To ensure that I can stand behind the use of the images, new permission must be requested if the company's activity changes.

By agreement, the images may be handed over to and shared by third parties in connection with marketing for the business holding the right of use to the images. Please note that crediting Photographer Birgitte Heiberg Andersen/Studio Merkbar is required for third-party use, as stated below.

The images may not be used by a third party for anything other than relevant marketing for the business holding the right of use to the images, nor may they be resold, as I as the photographer retain the copyright to the images pursuant to section 6. Naturally, I also do not resell images of individuals without prior permission from the person concerned.

Conditions for use of images purchased for private use

Once the images have been delivered to you, you have the right to use them for private purposes, including printing them, giving them as gifts to friends and family, and sharing them on social media and websites of a private nature. If the images were ordered for a private purpose, it is not permitted to use the images in marketing without prior permission.

Images selected in the selection gallery

Images sent for selection may not be used in any way, including copied, downloaded, photographed, printed or shared, as they may only be viewed for the purpose of selection in connection with ordering.

Right of withdrawal

As the images are produced according to your specifications and with a clear personal character, the right of withdrawal lapses as soon as you have chosen the images from the selection gallery to be fully edited, or have downloaded and paid for images directly from your gallery.

Data processing

In order for us to enter into an agreement, I need to process the following information about you:

Images

I process your personal data for the purpose of delivering the product to you and to handle enquiries regarding your purchase. Processing takes place in accordance with Studio Merkbar's privacy policy.
